Sec. 1. Definitions, as used in the
ordinance, unless the context otherwise indicates.
a) Dog - shall mean both male and female dogs
b) Owner
– shall mean any person or persons, firm, association or corporation owning or
keeping, harboring or in possession of, or having the control of a dog.
c) At
Large – shall mean off the premises of the dog’s owner and not under control
and restraint of the dog’s or a member of his immediate family, either by
leash, cord or chain, which shall not be more than (8) feet long or (at heel)
or within a vehicle being driven or parked on the streets or highways.
Sec. 2. At Large – It shall be unlawful for the owner
of a dog to cause or permit such dog to be at large.
Sec. 3. Noisome – It shall be unlawful for the owner
of a dog to cause or permit such dog to disturb the peace of any person by
biting, chasing or continued barking or
howling or in any other manner, or to destroy the property of any person.
Sec. 4. Dog in Heat – It shall be unlawful for the
owner of a dog to cause or permit such dog to be beyond the owners premises at
any time she is in heat unless such
dog is restrained by a leash, cord or chain, which shall not be more than (8)
feet long, by the owner or a member of his immediate family.
Sec. 5. Validity – It is the intention of the
municipality that each separate section of this ordinance shall be deemed
independent of all other sections herein, and it
is further the intentions of the municipality that if any provisions of this
ordinance be declared invalid all other sections thereof shall remain valid and
enforceable.
Sec. 6. Penalty – Every person convicted of a
violation of any provision of this ordinance shall be punishable by a fine of
not more than $20.00 (Twenty) to be recovered
by a complaint before the Maine District Court, District 11, Division of
Southern Oxford County; subject, however, to the rights of exception and appeal are provided by law. All fines recovered shall be to the use and
benefit of the inhabitants of the Town of Paris.
Sec. 7. Amendments – This ordinance may be amended by
a majority vote of any legal town meeting when such amendments are published in
the warrant calling for the
meeting.
Sec. 8. Repeal of Conflicting Ordinances – All existing
dog ordinances of Town of Paris are
hereby repealed insofar as they may be inconsistent with the provisions of this ordinance.
Sec. 9. Effective Date – This ordinance shall be in
full force and effective as soon as the town votes to enact it.
